A law firm has threatened a legal suit against the government of South Sudan at the East African Court of Justice if it fails to “unconditionally release” the former mayor of Juba City Council, Kalisto Ladu.

The Pan African Law Chambers, on behalf of their client, Ann-Grace Juan—Kalisto’s wife—served the Minister of Justice and Constitutional Affairs, Ruben Madol, with the demand letter.   

According to the letter, the firm stated that the arrest of the former mayor was against the law of the country and the region as well and therefore called on the government to unconditionally release him.

“We therefore urge the unconditional release of Mr. Kalisto Ladu with immediate effect,” it partly read.

The firm, however, gave the country an ultimatum on which they should act.

“Take further notice that, if you do not comply within 24 hours from the date of receiving this notice, we shall institute legal proceedings against you at your peril. If, however, you have no intention of complying, kindly inform us immediately so that we may institute the reference without delay,” the demand letter read.

“Failure to adhere to the above points or requests expounded in paragraph 13 will leave us with no option apart from filing a reference against the Republic of South Sudan for violations of Articles 5, 6(d), and 7(2) of the East African Community (EAC) Treaty,” it added.

The law firm argued that it had received information regarding the deterioration of the health of the former mayor, hence the call for immediate, unconditional release.

“We have credible information that the health of Kalisto Ladu is deteriorating rapidly daily” the statement partly read

The former Juba Mayor, Kalisto Lado, was alleged to have been arrested by the security apparatus.

His arrest attracted condemnation from many institutions in the country and outside.
